IS SEX OFFENDER REGISTRATION MANDATORY?
This is a common question that many clients ask their attorneys. You must first understand how the law defines rape. Under Virginia Code §18.2-61, rape is the use of physical force, coercion, or threats to make another person perform sexual intercourse against that person’s will. The offense is considered a felony, and under Virginia law, punishes felonies in this way.
Here are the potential penalties for a rape conviction:
- 5 years and possible life imprisonment
- If the victim is less than 13, then possible 25 years to life
Defendants may also be forced to pay monetary restitution to victims if the judge believes that this is warranted. Many of the conditions will depend on the circumstances of the individual cases. Finally, the law also requires sex offenders to register with the Virginia Sex Offender Registry. Without doing this step, one could face additional penalties, which could include additional time in prison.
