I just got a drug charge dismissed against a client who was arrested for possessing a Schedule 1 in his car. He did not admit the drugs were his and the government couldn’t prove he knew they were in his car.

Each of these kinds of cases stand or fall on the facts in each case, but often these kinds of cases are easy to charge but subject to dismissal so long as it can’t be proven the defendant knew of the character of the drugs and exercised some degree of dominion and control over them. Just because the drugs are in your car doesn’t mean they are yours!
